1. Summary

This page summarizes the agreement. Sections 2 to 16 are the binding text.

2. Parties

1618: The Memeplex Weaving Company Sàrl, trading as 1618 Robotics, Rue des Charmilles 1, c/o Arbitri Sàrl, 1203 Geneva, Switzerland, Swiss company number CHE-290.862.749. Contact: sales@1618robotics.com. Official WhatsApp: [TO CONFIRM: number]. 1618 has no company or address in Mexico [TO CONFIRM].

You: the person who signs in section 16 ("the Contributor", "you").

The Client: the company that commissions the recordings from 1618 and runs the recording app ([BUYER]). 1618 does not name it in this document for confidentiality [TO CONFIRM: whether the name is included in the signed version, section 12]. The Client is not a party to this agreement.

3. What you do

3.1 With a phone strapped to your forehead with the strap, you record your own real manual work, while you do it, at commercial or industrial sites (for example workshops, commercial kitchens, building maintenance, construction sites). You use the recording app that 1618 tells you to use ("the App", [BUYER APP]).

3.2 In a private home, you only record if you are doing a real, paid service there (for example a repair or professional cleaning) and the person who hired you allowed it in writing (Annex B of Format MX-3).

3.3 You follow the recording guide that 1618 gives you (phone position, visible hands, clip length, tasks the Client does not accept) [TO CONFIRM: name and version of the guide]. The guide describes the result the Client accepts. It does not describe how to do your trade.

3.4 You use your own phone, which must be a model the Client accepts, and your own data plan. 1618 checks the model before you start (privacy notice, section 3).

3.5 You decide. You decide whether you record, when, how many hours and at which of the sites with permission. You can turn down any task or site without giving reasons and without losing anything. There is no minimum number of hours. You can work for other people or companies at the same time, even on similar projects, as long as you respect section 12.

4. The Client's App and your videos

4.1 You sign up for the App directly, with the organization code 1618 gives you, and you accept the Client's terms and privacy notice. Those documents are an agreement between you and the Client. 1618 does not write or control them. Read them before you record. [TO CONFIRM: get the Client's terms and privacy notice in Spanish and attach or link them here.]

4.2 Your videos are uploaded from the App to the Client. The rights in the videos, their use, their retention and your rights over the personal data in them are governed by the Client's documents. 1618 does not receive a license to your videos and does not sell them.

4.3 1618 does not receive, store, see or edit your videos. As a partner organization of the Client, 1618 sees in the Client's portal your account and session data: account email, dates, duration, task, accepted hours and quality or fraud flags [TO CONFIRM: whether the portal shows video thumbnails or clips].

4.4 If you want a video deleted, or have a question about what the Client does with it, write to the Client through the channels in its privacy notice. 1618 helps you pass the request on if you ask, but it cannot delete videos.

5. Review and acceptance

5.1 The Client reviews each video. According to the Client, review normally takes 24 to 72 hours. Only the hours the Client accepts are paid ("accepted hours").

5.2 Videos that, at the Client's monthly close, are flagged for correction or for fraud are not paid. The Client considers fraud to include, among other things: recording a screen or another person's video, pointless actions or actions with no real purpose, minimal movement or standing still, recording in a home with no real paid service, recording another person instead of your own work, and repeating mistakes after receiving feedback. 1618 gives you the full list in the guide.

5.3 The decision to accept or reject is the Client's. 1618 cannot change it. If you disagree with a rejection or with the suspension of your account, tell 1618 within [TO CONFIRM: 5] business days. 1618 presents your case to the Client and tells you the result. To do that, 1618 shares your account email and your explanation with the Client.

6. Payment

6.1 Rate. 1618 pays you the rate per accepted hour in the table at the top, in Mexican pesos (MXN). Time is counted using the accepted hours the Client reports to 1618, not the time you recorded.

6.2 Starter bonus. [TO CONFIRM: ___ MXN] once, when you reach [TO CONFIRM: 10] accepted hours.

6.3 Allowances. [TO CONFIRM: a mobile data allowance of ___ MXN a month and a phone wear allowance of ___ MXN a month, in months with at least ___ accepted hours; or delete this section. See list for lawyer, item 3.]

6.4 When. [TO CONFIRM, choose one option:]

6.5 How. By transfer to a Mexican bank account in your name (18-digit CLABE), through Wise or another payment service [TO CONFIRM]. 1618 pays the transfer fees. No payments are made to another person's account.

6.6 Statement. With each payment you receive a breakdown by WhatsApp or email: period, accepted hours, rate, bonuses, allowances, deductions and total.

6.7 No other deductions. 1618 deducts nothing from your payment, except the corrections under option 2 and the withholdings Mexican law requires it to make [TO CONFIRM: whether 1618 must withhold ISR (income tax) or IVA (VAT), section 7].

6.8 On termination. If this agreement ends, 1618 pays you the accepted hours up to the termination date, on the next payment date.

7. Taxes

7.1 You receive income as an individual who provides services independently. You are responsible for your own tax obligations in Mexico, for example registering with the RFC, choosing a regime (for example the Simplified Trust Regime, RESICO, art. 113-E of the Income Tax Law) and filing your returns.

7.2 [TO CONFIRM with a Mexican lawyer or accountant: (a) whether 1618, as a foreign company with no permanent establishment in Mexico, must withhold ISR or IVA; (b) whether you must issue a CFDI to 1618 as a foreign client (generic RFC XEXX010101000) and at what IVA rate; (c) whether it is enough for 1618 to ask for your RFC; (d) whether the technology platforms regime applies (art. 113-A of the Income Tax Law).]

7.3 1618 does not register you with the IMSS, because you are not its worker (section 10) [TO CONFIRM: see section 10.4].

8. You never pay anything

8.1 1618 never charges you to take part: no sign-up fee, no training fee, no charge for the strap or for shipping, no deposit or guarantee, and no "fee" of any kind. If someone asks you for money in the name of 1618, it is a scam. Tell us.

8.2 1618 never asks you for passwords, PINs, verification codes, card details or access to your online banking. To pay you, it only needs your name and your CLABE.

8.3 1618 only contacts you through the official WhatsApp [TO CONFIRM: number], by email from @1618robotics.com and through its coordinators, whose names we give you when you start [TO CONFIRM: how to verify a coordinator].

9. Head strap

[TO CONFIRM, choose one option. Recommendation: option A, see list for lawyer, item 4.]

Option A (gift). 1618 gives you a strap to hold the phone on your forehead. It is yours from the moment you receive it. You do not return it and you pay nothing for it, even if you stop taking part.

Option B (loan). 1618 lends you a strap. It still belongs to 1618. You return it within [TO CONFIRM: 30] days after this agreement ends, by the method 1618 tells you and pays for. If you do not return it, 1618 does not charge you anything or deduct anything from your payments [TO CONFIRM].

In both cases: the strap is only for holding the phone. Before each use, check that the phone is secure. If the strap breaks, tell 1618 to get another one at no cost.

10. Independent contributor

10.1 This is an agreement for independent services between two parties acting on their own account [TO CONFIRM: type of contract under the Federal Civil Code]. It is not an employment contract.

10.2 In practice this means:

(a) you decide whether you record, when, how much and at which site with permission (section 3.5);

(b) 1618 does not give you a schedule, shifts, minimum targets or supervisors, and does not give you orders on how to do your trade;

(c) you use your own phone, your own data plan and your own work tools;

(d) there is no exclusivity (section 3.5);

(e) payment is for accepted results, not for time on call; and

(f) you have no right to a salary, Christmas bonus (aguinaldo), vacation, profit sharing or benefits from 1618 or the Client, and 1618 has no right to demand work from you.

10.3 If you record while working for your own employer, the site permission (Format MX-3) is given by your employer. Your employer remains your only employer. 1618 does not pay your salary or give you work instructions, and your employer cannot make you record.

10.4 [NOTE FOR LAWYER, DELETE BEFORE SIGNING: the label does not decide. The Federal Labor Law defines subordinate work (arts. 8 and 20) and presumes an employment relationship between whoever provides personal work and whoever receives it (art. 21). Since 22 June 2025, the chapter on work on digital platforms (arts. 291-A to 291-U) has been in force; it treats as subordinate the physical work managed through a platform that assigns tasks and exercises command and supervision by digital means. The App assigns tasks, reviews quality and can suspend accounts. See list for lawyer, items 1 and 2.]

11. Conduct and safety

11.1 Age. You must be 18 or older. Before you start, 1618 checks your official photo ID (for example the INE card) by video call or in person, without keeping a copy or the number.

11.2 Minors. No one under 18 may appear in a video. If a minor comes into the picture, stop recording and do not upload that video. If you already uploaded it, tell 1618 at once, and 1618 tells the Client.

11.3 Site permission. At a business, you only record after the owner or manager has signed the 1618 Site Permission (Format MX-3), and only in the areas, on the days and for the tasks that permission sets out. In a home, only with the written permission of the customer who hired you (Annex B of Format MX-3).

11.4 Other people. Ask anyone nearby to stay out of the picture. If someone does not want to appear, move away or stop recording. Show the site notice (Annex A of Format MX-3) if asked. You never record secretly. You never record in restrooms, changing rooms or rest areas.

11.5 Private things. Keep out of the picture, as far as possible: screens, documents, IDs, cards, money, vehicle license plates, customer data and anything the site owner marks as confidential. If the phone records sound, avoid conversations [TO CONFIRM: whether the App records audio].

11.6 Driving. You never record while driving, or while operating a vehicle, forklift or mobile machinery. The Client does not accept those tasks either.

11.7 Machines and heights. You do not record near lathes, grinders or machines with exposed rotating parts. You do not record while working at height, unless the phone has an extra safety strap and the site allows it [TO CONFIRM]. You use the protective equipment the site requires. If the strap gets in the way of your helmet or protective equipment, you do not record that task.

11.8 Safety first. Stop recording as soon as it is not safe. No recording is worth an accident. 1618 does not pay more for dangerous tasks.

11.9 Your phone. You use your phone at your own risk. [TO CONFIRM: support from 1618 for damage to the phone during recording, maximum amount and requirements; or none.] 1618 has no insurance that covers you [TO CONFIRM].

11.10 Honesty. You do not record fake, repeated or pointless tasks, you do not upload another person's videos and you do not share your account.

12. Confidentiality

12.1 You keep secret: the Client's name, the name of the App and its organization code, the Client's guides and specifications, what the Client pays 1618, and information about the sites where you record.

12.2 You do not post any of the above on social media, groups, ads or videos, and you do not share it with other people, except your close family and your advisers (accountant, lawyer), who must keep the same secret. You may say that you record your work for a 1618 robotics project.

12.3 This obligation does not apply to what is already public through no fault of yours, or to what an authority or the law requires you to disclose. Nor does it stop you from talking about your own pay or your working conditions.

12.4 The obligation lasts while you take part and for [TO CONFIRM: 2] years afterwards.

12.5 1618 also keeps your personal information secret, in line with its privacy notice.

13. Your personal data

13.1 1618 processes your identification, contact and payment data, your phone model, your WhatsApp messages and the session data it receives from the Client, as described in its Full Privacy Notice (Format MX-2), which you received before signing.

13.2 Your videos and the personal data in them are processed by the Client, under its own privacy notice (section 4).

14. Termination

14.1 You can end this agreement whenever you want, without giving reasons and without penalty, by telling 1618 by WhatsApp or email.

14.2 1618 can end it with [TO CONFIRM: 7] calendar days' notice, for example if the project with the Client ends.

14.3 1618 can end it immediately, with written notice explaining the reason, if: you knowingly record a minor; you record without the site's permission or record people who do not want to appear; you record while driving; you commit fraud under section 5.2 or 11.10; you disclose confidential information (section 12); or the Client permanently suspends your account.

14.4 On termination, 1618 pays you what is due under section 6.8. Sections 7, 12, 13 and 15 continue to apply.

15. General provisions

15.1 Changes. 1618 tells you about any change to these terms [TO CONFIRM: 15] calendar days in advance. Changes to the rate only apply to hours recorded after the notice. If you do not agree, you can end the agreement (section 14.1).

15.2 Notices. Notices between the parties are sent by WhatsApp or email to the details in section 16.

15.3 Electronic signature. The parties may sign this agreement electronically (Federal Civil Code, arts. 1803 and 1834 bis) [TO CONFIRM: signature service, see note 04 of the consent pack].

15.4 Law and courts. [TO CONFIRM: federal laws of Mexico and the courts of the city where the Contributor lives.]

15.5 Language. The Spanish version is binding. The English version is a courtesy translation.

15.6 Entire agreement. This document and the Full Privacy Notice are the entire agreement between you and 1618 about this project.
